TERMS OF USE — RL-GUESTS Wi-Fi NETWORK
Terms and conditions for the provision of data services through the RL-GUESTS wireless network (as defined below)
by ROWAN LEGAL, advokátní kancelář s.r.o. ("Terms") pursuant to Section 1746(2) and Section 1751 of Act
No. 89/2012 Coll., the Civil Code, as amended ("CC").
- Introductory Provisions
- The following terms have the meanings defined in this clause 1.1 and are capitalised throughout the
Terms:
- "Authorisation" — the process of authentication and authorisation, ending with a
successful or unsuccessful connection to the Internet through the RL-GUESTS Network.
- "Internet" — the global system of interconnected computer networks and devices.
- "IT Support" — a collaborator of the Provider reachable at it@rowan.legal.
- "End Device" — a user end device such as a laptop, computer, mobile phone, tablet or
similar device used by an ordinary user for everyday purposes.
- "Provider" — ROWAN LEGAL, advokátní kancelář s.r.o., registered office at Na
Pankráci 1683/127, Nusle, 140 00 Prague 4, ID No.: 284 68 414, registered in the Commercial
Register kept by the Municipal Court in Prague, file ref. C 143781.
- "RL-GUESTS Network" — a Wi-Fi network operating on the 2.4 and 5 GHz bands or a LAN
wired network with hotspot functionality providing Internet access at the Provider's
premises.
- "Parties" — the Provider and the User collectively and each individually as a
"Party".
- "User" — a natural person entering into the Authorisation process for the purpose of
using the RL-GUESTS Network or using the services of the RL-GUESTS Network.
- Subject and Purpose of the Terms
- The subject of these Terms is the arrangement of the rights and obligations of the Parties in
relation to the use of the RL-GUESTS Network.
- The purpose of these Terms is to enable the User to access the Internet through the RL-GUESTS
Network under the conditions set out herein and to protect the Provider against any conduct of the
User that is prohibited by these Terms or otherwise unlawful.
- User's Declarations and Obligations
- The User declares that:
- they have provided correct and truthful data during the Authorisation and have not provided
any personal data to which they would not be authorised to grant consent for processing;
- they have read these Terms, in particular their obligations under clause 3.2, and by clicking
the checkbox during Authorisation confirm that they have read, understood and unconditionally
agree to them;
- they are connecting to the RL-GUESTS Network through an End Device that meets all conditions
set out in these Terms and are legally, factually and technically prepared to fulfil all
their obligations arising from these Terms.
- The User undertakes to:
- use the RL-GUESTS Network only through End Devices and in a manner expressly permitted by
these Terms that does not affect the operation of the RL-GUESTS Network and/or End Devices,
and not to unnecessarily burden the RL-GUESTS Network, for example by uploading or
downloading large files;
- protect their login credentials or other means of Authorisation, not provide them to third
parties, and secure access to them and End Devices in a manner that prevents interference or
use by unauthorised persons;
- back up all data transmitted over the RL-GUESTS Network and on End Devices, as the Provider
does not guarantee the integrity, quality or other properties of transmitted data;
- use the RL-GUESTS Network and connected End Devices in a manner that does not cause harm to
the rights or interests of third parties, and use the Network only in compliance with
applicable laws, good morals and fair business practices;
- not use the RL-GUESTS Network in an annoying (including spam), offensive, threatening,
obscene, rude, racist, sexist or otherwise undesirable or inappropriate manner;
- not collect email addresses or other personal data from the RL-GUESTS Network, End Devices
or related technology;
- ensure that their End Device is protected by a current version of antivirus software;
- notify IT Support without undue delay of any defects or unusual behaviour of the RL-GUESTS
Network.
- The User is responsible for any damage, unjust enrichment, costs, expenses or monetary or other
claim arising from any breach of these Terms on their part.
- Provider's Rights and Obligations
- The Provider is entitled at all times and without prior notice to:
- carry out short-term or long-term interruptions to the RL-GUESTS Network for maintenance or
other legitimate reasons;
- suspend or restrict the RL-GUESTS Network if its provision is prevented or limited by an
external event, such as force majeure or a decision of competent authorities;
- interrupt, cancel, prevent or restrict the User's access to the RL-GUESTS Network if it is
used in breach of the Terms or if there is a risk to the Network's operation;
- change the access credentials to the RL-GUESTS Network;
- cease providing the RL-GUESTS Network service.
- The Provider's authorisation expires 24 hours after the User's last login. The User may reconnect
under a new account.
- User's Rights
- The User has the right to use the data services of the RL-GUESTS Network in a manner consistent
with these Terms.
- The User may contact IT Support with comments, complaints or fault reports.
- The User may request removal of access to the RL-GUESTS Network through IT Support at any time.
- Network Functionality and Security
- The RL-GUESTS Network is provided as a free benefit to the User in its current state. No additional
security, monitoring or similar services are guaranteed. The User uses the RL-GUESTS Network at their
own risk.
- The RL-GUESTS Network is a free service and its use is not legally enforceable.
- Personal Data and Privacy Statement
- The Provider is the controller of the User's personal data and processes it in accordance with
Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll.
- Personal data is processed for the purposes of contract performance, records, statistics, protection
of legal claims and fulfilment of legal obligations, on the basis of the Provider's legitimate
interest.
- Personal data is retained for the duration of the Terms and, where applicable, for the limitation
period (typically no more than 16 years after termination).
- The Provider processes: device information (MAC address, OS), data volume, connection location and
time, email address, mobile phone number, and visited websites.
- The User has the right to: access, rectification, erasure, restriction of processing, data
portability, objection, and to lodge a complaint with the Office for Personal Data Protection.
- Consent to the Terms
- If the User disagrees with any provision of the Terms, they must not use the RL-GUESTS Network.
- Validity and Amendments
- The Provider reserves the right to amend these Terms at any time. Amendments take effect upon
publication on the Provider's web portal.
- These Terms take effect on 1 February 2022.
